PARTICIPATION, ASSUMPTION OF RISK, AND RELEASE AGREEMENT
This Participation, Assumption of Risk, and Release Agreement (“Agreement”) is entered into by (a) the undersigned Volunteer (“Volunteer”) and, if the Volunteer is a minor, the undersigned parent or legal guardian of the Volunteer (“Guardian”), and (b) the Christian Church (Disciples of Christ) (“Church”).
RECITALS
The Church is a not-for-profit entity incorporated and having its principal place of business in the state of Indiana.
Certain ministries of the Church organize, administer, and/or support certain charitable projects (“Projects”).
Volunteer desires to participate as a volunteer in one or more Projects.
Volunteer (and, if applicable, Guardian) understand(s) that participation in any such Project may include (i) general cleanup, (ii) debris removal, (iii) repair work, (iv) travel to and from the site where such activities will be performed, (v) consuming food and sharing accommodations that are made available to volunteers at the site, and (vi) other activities that are reasonably necessary to complete the Project (“Activities”).
Volunteer (and, if applicable, Guardian) understand(s) and acknowledge(s) that participation in the Activities involves risk and may expose Volunteer to injury or other harm.
The Church desires to facilitate Volunteer’s participation in Projects and Activities and, at the same time, to protect the Church, its ministries and affiliates, and its and their representatives against exposure to claims.
Volunteer (and, if applicable, Guardian) and Church have agreed to enter into this Agreement.
AGREEMENT
In consideration of the foregoing and the promises set forth below, the parties agree as follows:
The Church agrees (a) to permit Volunteer to participate in Activities related to the following Project(s), and (b) to provide Volunteer with any equipment and supplies that are necessary to engage in such Activities:
Disaster Recovery San Angelo, Texas
Volunteer (and, if applicable, Guardian) voluntarily assume(s) all risks associated with Volunteer’s participation in such Project(s) and related Activities.
Volunteer (and, if applicable, Guardian), on behalf of themselves and their successors, heirs, insurers, and assigns, release(s) and forever discharge(s) the Church, the Church’s ministries, affiliates, Regions, and member churches, and their respective officers, members, agents, employees, representatives, insurers, and assigns (collectively, “Released Parties”), from any and all claims, demands, rights, and causes of action of whatever kind or nature, known or unknown, at law or in equity (including, but not limited to, claims for bodily injury, personal injury, illness, death, and/or property damage), based upon, arising out of, or in any manner connected with Volunteer’s participation in any Project or Activities, regardless of whether any such claims, demands, rights, or causes of action are, or may have been, caused or contributed to, in whole or in part, by the negligence of any of the Released Parties (“Released Claims”).
If Volunteer, or anyone acting on Volunteer’s behalf or for Volunteer’s benefit, asserts a Released Claim against any of the Released Parties, then Volunteer (and, if applicable, Guardian) shall indemnify and hold such Released Party(ies) harmless from all loss, cost, and expense (including but not limited to reasonable attorneys’ fees) incurred in (a) defending against the Released Claim, and (b) pursuing Volunteer (and, if applicable, Guardian) for indemnification.
Volunteer (and, if applicable, Guardian) understand(s) and acknowledge(s) that none of the Released Parties is obligated to purchase or maintain insurance coverage (a) for Volunteer or (a) related to any Project.
The parties stipulate and agree that this Agreement shall be governed by and construed in accordance with the laws of the state of Indiana. The state courts in Marion County, Indiana, shall have exclusive jurisdiction to enforce the terms of this Agreement. Volunteer (and, if applicable, Guardian) consent(s) to personal jurisdiction in Marion County, Indiana, in any case based upon or arising out of this Agreement and waives any and all objections to such jurisdiction on any grounds.
For Galilee CDC:
Galilee CDC, and their partner organizations, private, nonprofit, and faith-based organizations, directors, officers, members and affiliates (herein referred to as Galilee CDC).
I, the volunteer, desire to work as a volunteer for Galilee CDC and engage in activities, as coordinated by Galilee CDC, related to being a volunteer. I understand that such activities may include, but may not be limited to, tree and debris removal/cleanup, application of tarps, and distribution of goods. I freely and voluntarily execute tis Release under the following terms.
1. RELEASE AND WAIVER. I hereby release and forever discharge Galilee CDC from any and all liability, claims, and demands of whatever kind either in law or in equity, which arise or may hereafter arise from my activities with Galilee CDC. I understand that this Release discharges Galilee CDC from any liability or claim that I may have against Galilee CDC with respect to bodily injury, personal injury, or property damages that may result from my activities with Galilee CDC. I also understand that Galilee CDC does not assume any responsibility for or obligation to provide financial or other assistance, including but not limited to medical, health, auto, or disability insurance in the event of injury or loss.
2. MEDICAL TREATMENT. I hereby release and forever discharge Galilee CDC from any claim which arises or may arise on account of first aid, treatment, or any service rendered in connection with my volunteer activities with Galilee CDC.
3. ASSUMPTION OF RISK. I understand that my volunteer activities may include work that is hazardous, including but not limited to work around power tools, heavy machinery, as well as transportation to and from the work site. I hereby expressly assume the risk of injury or harm in the volunteer activities.
4. INSURANCE. I understand that Galilee CDC does not carry or provide health, medical, disability, or auto insurance coverage for any emergent volunteer. Each volunteer is expected and encouraged to obtain his or her own medical, health, disability and auto insurance.
5. OTHER. I agree that this Release and Waiver is intended to be as broad and inclusive as permitted by local and state laws. I agree that in the event that any provision of this release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such provision shall not otherwise affect the remainder of the Release and Waiver, which shall continue to be held enforceable.

This Waiver, Release, and Hold Harness Agreement (“Release”) is made on this day
WHEREAS, in consideration of the willingness of Grace Christian Church, San Angelo, TX and its staff and volunteers to provide services to your group/organization/affiliation, Recipient is willing to execute this Waiver, Release and Hold Harness Agreement;
NOW THEREFORE, Recipient, on behalf of itself and its heirs, assigns and all other persons or entities claiming by, under or through Recipient, represents, covenants and agrees as follows:
1. Recipient accepts and voluntarily incurs all risks of any injuries, damages, or harm which arise during or result from any activities of or services provided by Grace Christian Church - a shared ministry of First Christian Church and Grace Presbyterian Chapel (PCUSA), San Angelo, TX or its staff members, officers, agents or representatives, except only to the extent caused by negligence or other fault of Grace Christian Church - a shared ministry of First Christian Church and Grace Presbyterian Chapel (PCUSA), San Angelo, TX and/or its staff, members, agents, representatives or insurers (“Released Parties”).
2. 3. Recipient agrees to indemnify and hold the Released Parties harmless from all losses, liabilities, damages, costs or expenses (including but not limited to reasonable attorneysʼ fees and other litigation costs and expenses) incurred by any of the Released Parities as a result of any claim or suits that (I) Recipient, (II) anyone claiming by, under or through Recipient, or (III) any third party, may bring against any of the Released Parties to recover any losses, liabilities, costs, damages, or expenses which arise during or result from the participation by, or services supplied by, any of the Released Parties, except only to the extent caused by the negligence or other fault of any of the Released Parties.
4. Recipient acknowledges having carefully read and reviewed this Waiver, Release, and Hold Harness Agreement, and Recipient represents that it fully understands and voluntarily executes the same.
